These Terms of Use ("Terms") govern your access to and use of the website, mobile application, and services provided by CREDOFINA FINTECH PRIVATE LIMITED ("Credofina," "we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By registering, accessing, or using our platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Payment Policy, and all other policies referenced herein. These Terms constitute a legally binding agreement between you and Credofina.

2. Description of Services

Credofina operates as a digital loan marketplace and Direct Selling Agent (DSA) connecting borrowers with regulated lending institutions including banks and Non-Banking Financial Companies (NBFCs). Our services include:

• Facilitating loan applications for personal loans, home loans, business loans, and loans against property.
• Providing loan comparison and eligibility assessment tools.
• Connecting borrowers with appropriate lending partners based on their profile and requirements.
• Assisting with documentation, KYC verification, and application processing.

Credofina is not a lender, bank, or NBFC. All loan decisions, interest rates, terms, and disbursal are at the sole discretion of our lending partners.

3. User Obligations

As a user of our platform, you agree to:

• Provide accurate, complete, and current information during registration and loan applications.
• Not misrepresent your identity, income, employment, or any other material information.
• Use the platform only for lawful purposes and in compliance with applicable laws.
• Not engage in any activity that could harm, disable, or impair our platform or interfere with other users.
• Keep your account credentials confidential and be responsible for all activities under your account.
• Not attempt to gain unauthorized access to our systems, data, or other users' accounts.
• Comply with all applicable Indian laws, regulations, and RBI guidelines.

4. Account Registration

To use certain features, you may need to create an account. You must be at least 18 years of age and a resident of India to register. You are responsible for maintaining the confidentiality of your account information and for all activities occurring under your account. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time if we suspect violation of these Terms, fraudulent activity, or misuse of the platform.

5. Loan Terms & Conditions

Loan products offered through our platform are subject to the terms and conditions of the respective lending partners. By applying for a loan through Credofina, you acknowledge that:

• Loan approval is subject to eligibility criteria, creditworthiness assessment, and documentation verification by the lender.
• Interest rates, processing fees, repayment schedules, and other loan terms are determined by the lending partner.
• Credofina does not guarantee loan approval or specific interest rates.
• You will enter into a direct loan agreement with the lending partner, not with Credofina.
• Repayment obligations are between you and the lending partner as per the loan agreement.

6. Intellectual Property

All content, trademarks, logos, designs, text, graphics, software, and other materials on our platform are the property of Credofina or its licensors and are protected by Indian intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on our platform without prior written consent from Credofina.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• Credofina shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• We do not guarantee the accuracy, completeness, or reliability of any information, loan offers, or interest rates displayed on our platform.
• Our total liability for any claims arising from these Terms or your use of the platform shall not exceed the fees paid by you to Credofina, if any.
• We are not liable for any actions, decisions, or omissions of our lending partners or third-party service providers.

8. Indemnification

You agree to indemnify, defend, and hold harmless Credofina, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these Terms, misuse of the platform, or infringement of any third-party rights.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

10. Dispute Resolution

In the event of any dispute arising from these Terms, both parties shall first attempt to resolve the matter amicably through good-faith negotiations. If the dispute is not resolved within 30 days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed mutually. The seat of arbitration shall be New Delhi, and proceedings shall be conducted in English.

11. Modifications

Credofina reserves the right to modify, update, or revise these Terms at any time. Changes will be effective upon posting on our platform with an updated "Last Updated" date. Your continued use of the platform after modifications constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
